MDM Notary Services Terms & Conditions
Effective Date: Date of Purchase
These Terms and Conditions ("Agreement") govern the purchase and use of services provided through Mark D. Miller, doing business as MDM Notary Services and any affiliated services through MDM Notary Services umbrella (“we,” “us,” or “our”). By placing an order through any of our websites or platforms, the customer (“you” or “Client”) agrees to be legally bound by the terms outlined below.
1. Scope of Services
1.1. MDM Notary Services works in strategic partnership with a network of reputable professional translators and certified translation companies.
1.2. All translation services offered are intended for documents requiring certification for use with domestic and foreign governments, including but not limited to immigration, legal, academic, and business purposes.
1.3. Translations are performed by native-speaking professionals and reviewed for compliance with ISO 9001:2018 standards.
2. Turnaround Time and Scheduling
2.1. We do not offer same-day translation services.
2.2. Orders may only be scheduled based on our publicly posted turnaround times, which vary based on volume, complexity, and language.
2.3. Clients who attempt to schedule services sooner than our posted turnaround timeframes waive any right to refund or cancellation based on delay.
2.4. All delivery timelines are estimates, not guarantees, though we strive for timely service.
2.5. Turnaround time is calculated from the moment the order is paid for, and that we will not proceed until payment is received; verbal or email communication is not considered confirmation of the project.
3. Translation Certification
3.1. All certified translations are delivered with a Certificate of Translation issued on the translation department's letterhead.
3.2. The Certificate affirms:

The translation is a true and accurate representation of the original.

The translator is fluent in both the source and target languages.

The translation was produced in accordance with ISO 9001:2018 accreditation, verified via annual independent audits.

The declaration is made under penalty of perjury.
3.3. Translations are certified electronically and do not contain a wet signature, unless specifically requested and approved in writing prior to processing.
3.4. All certifications are notarized by a Notary working with MDM Notary Services. Notarization is provided at no cost — the $50 fee is for certification services, which is shared between the Translator and Notary.
4. Modifications and Client Requests
4.1. We allow minor adjustments to names, addresses, or formatting in translations when supported by clear documentation.
4.2. We do not accept directive instructions from clients regarding how translations should be rendered, as our translators are obligated to provide a correct and professional interpretation of the original content.
4.3. Attempts to influence or override translator decisions may result in service denial without refund.
5. Document Submission & Delivery
5.1. Clients are responsible for uploading legible and complete documents to our platform at the time of order.
5.2. Final translations and certifications are delivered electronically via email or secure download.
5.3. Physical delivery of certified documents is available upon written request and may incur additional charges.
6. Shipping, Handling & Delivery Disclaimer
6.1. When physical documents are shipped, mailed, or delivered at the request of the client, MDM Notary Services acts solely as a facilitator and does not assume responsibility for loss, damage, delay, theft, or misdelivery once documents are tendered to a third-party carrier, courier, postal service, or delivery provider.
6.2. All shipping and delivery services are performed by independent third parties. Any claims related to lost, damaged, delayed, or mishandled documents must be made directly with the selected carrier. Clients are solely responsible for selecting shipping options, including but not limited to tracking, signature confirmation, delivery speed, and insurance coverage.
6.3. Address Verification Requirement

All clients are required to review and verify the accuracy of the shipping address prior to shipment. Once an address has been confirmed and the shipment has been released, MDM Notary Services is not responsible for delays, misdelivery, or non-delivery resulting from incorrect, incomplete, or improperly entered address information provided by the client.
6.4. Limitation of Liability
MDM Notary Services is not liable for any damage(s) arising during transit, including but not limited to:

Physical damage to documents

Loss or destruction of documents
-
Delays affecting filing, submission, or legal deadlines

Consequential, incidental, or indirect damage(s) resulting from shipping or delivery issues
6.5. Proof of shipment and tracking information will be provided when available. Once documents leave our possession, or our contracted vendor’s possession, risk of loss transfers fully to the client.
6.6. To the maximum extent permitted by law, any liability, if established, shall be strictly limited to the amount paid for the specific notary or processing service rendered and shall not extend to shipping-related issues or third-party carrier actions.
7. Refunds and Cancellations
7.1. Due to the nature of customized language services, all sales are final once translation work has begun.
7.2. Orders may be canceled for a full refund only if requested in writing prior to commencement of translation.
7.3. Orders scheduled outside of our turnaround policy (i.e., for sooner than we offer) are ineligible for refund.
8. Apostille Services
8.1. Apostille services are offered separately and priced individually. Each Apostille is unique based on destination country and jurisdiction requirements.
8.2. Clients understand that Apostille timelines and acceptance vary by state and country. We cannot guarantee acceptance for foreign use in jurisdictions known to reject electronic certification.
9. Remote Online Notarization Services
9.1 In regard to Remote Online Notarization Services, MDM Notary Services operates primarily as the commissioned Remote Online Notary Public performing the notarization services. In limited circumstances, MDM Notary Services may coordinate with another legally commissioned and authorized Remote Online Notary Public when necessary to complete a transaction or accommodate scheduling or service needs.
9.2 MDM Notary Services may also coordinate, when required or requested, qualified remote witnesses, language interpreters or translators, document handling, printing, courier, shipping, and delivery services in connection with a notarization transaction.
9.3 Fees charged by MDM Notary Services may include notarial fees permitted by applicable law, along with additional administrative, convenience, technology, scheduling, coordination, printing, shipping, courier, translation, witness, and document handling service fees, which may include, but are not limited to:
• Remote Online Notarization services
• Scheduling and coordination of notarization appointments
• Management and oversight of the notarization workflow
• Coordination of required or requested witnesses
• Coordination of language interpreters or translators
• Document printing, packaging, shipping, courier, tracking, and delivery services
• Electronic document handling and delivery services
9.4 Any third-party Remote Online Notary Public, witness, interpreter, translator, printer, courier, shipping provider, or delivery vendor utilized in connection with a transaction operates as an independent contractor or independent service provider. Compensation paid to such parties may be governed by separate agreements and is separate from statutory notarial fees.
9.5 MDM Notary Services does not provide legal advice, does not guarantee the acceptance of documents by any receiving agency or institution, and is not responsible for the independent actions, availability, or performance of third-party service providers engaged in connection with a transaction.
10. Limitation of Liability
10.1 Mark D. Miller DBA MDM Notary Services, including any independent contractors, vendors, or service providers engaged in connection with a transaction, shall not be liable for:
• Errors, omissions, delays, or issues resulting from illegible, inaccurate, incomplete, altered, or fraudulent documents or information provided by the client or third parties.
• Delays, rejections, refusals, or non-acceptance by government agencies, foreign governments, embassies, consulates, courts, financial institutions, title companies, employers, schools, or any other receiving entity outside the control of MDM Notary Services.
• Service interruptions, technology failures, internet outages, platform malfunctions, shipping delays, courier errors, or circumstances beyond reasonable control.
• Consequential, incidental, indirect, special, or punitive damages, including but not limited to financial loss, loss of opportunity, lost profits, missed deadlines, travel expenses, or delays associated with related transactions or applications.
10.2 The maximum liability of Mark D. Miller DBA MDM Notary Services for any claim arising from or related to services provided shall not exceed the total amount actually paid by the client for the specific service giving rise to the claim.
10.3 MDM Notary Services does not guarantee the legal sufficiency, effectiveness, recording, filing, acceptance, or outcome of any document, transaction, or notarization.
11. Dispute Resolution
11.1 MDM Notary Services is based in Marion County, Florida, and these Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida.
11.2 In the event of any service issue, concern, or dispute, the client agrees to provide MDM Notary Services with written notice of the issue and allow at least fifteen (15) calendar days for review and an opportunity to resolve the matter prior to initiating any chargeback, complaint, arbitration, or legal action.
11.3 Any dispute that cannot be resolved through good-faith discussions may first be submitted to voluntary mediation in Marion County, Florida, before either party pursues arbitration or litigation.
11.4 Venue for any legal proceeding arising out of or relating to services provided by MDM Notary Services shall be exclusively located in Marion County, Florida, unless otherwise required by applicable law.
12. Indemnification
You agree to indemnify and hold harmless MDM Notary Services and its affiliates from any claims, liabilities, or damages arising from your misuse of our services or breach of this Agreement.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida without regard to conflict of law principles.
14. Controlling Language
This Agreement may be provided in both English and Spanish. The Spanish version is provided for convenience and informational purposes only. In the event of any inconsistency, discrepancy, or conflict between the English and Spanish versions, the English version shall govern and control in all respects.
15. Updates and Modifications
We reserve the right to update these Terms at any time. The latest version will always be available on our website, and continued use of our services constitutes acceptance of any changes.
By purchasing translation or apostille services through Mark D. Miller DBA MDM Notary Services or any affiliated entity, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
